Sometimes, the Company may receive personal information such as a resume/CV from a person or entity who is a third party on behalf of another person whose personal information being shared.

1. What is “personal information”?

1. The Privacy Act 1988 (Cth) currently defines “personal information” as meaning information or an opinion about an identified individual or an individual who is reasonably identifiable:
   whether the information or opinion is true or not; and
   whether the information or opinion is recorded in a material form or not.
2. If the information does not disclose your identity or enable your identity to be ascertained, it will in most cases not be classified as “personal information” and will not be subject to this privacy policy.

2. What information do we collect?

The kind of personal information that we collect from you will depend on how you use the website/s or online system we deploy. The personal information which we collect and hold about you may include:

3. Sensitive Information

Sensitive information is a special category of personal information under the Privacy Act 1988 (Cth). The sensitive information we may require access to has been listed in the information we collect, but specifically, it is the information or an opinion about you, including racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership or a professional or trade association, membership of a trade union, sexual preferences or practices, criminal records, and health information.
As part of the services we provide, we may arrange health surveillance, drug and alcohol testing, medical testing or police checks as required by our clients or legislation. If you are required to provide any of this sensitive information, we will seek your consent first, including your consent to disclose this information to our client where the client requests this.

4. How we collect your personal information

1. We may collect personal information from you whenever you input such information into the website or portals that we use in our operations.
2. We may collect information when you converse with us on phone calls or emails, or in office wherever you complete forms or paperwork.
3. We may collect information about you that is publicly available, for example, a LinkedIn profile, or similar platforms.
4. We also collect cookies from your computer which enable us to tell when you use the website and also to help customise your website experience. As a general rule, however, it is not possible to identify you personally from our use of cookies.

5. Purpose of collection and sharing information

1. The purpose for which we collect personal information is to provide you with the best service experience possible on the website, portals, and otherwise.
2. We customarily disclose personal information only to our service providers who assist us in operating the websites, portals, and online storage systems. Your personal information may also be exposed from time to time to maintenance and support personnel acting in the normal course of their duties.
3. We also share some information of potential and actual labour hire employees with potential or actual host employers, as well as information of permanent job seekers. This is deemed necessary in our operations, to identify and deploy labour hire employees into suitable employment with host employers or direct employers.
4. Additionally, we may disclose personal information to our insurers, workers compensation bodies or groups, contractors or suppliers who are directly involved in recruitment operations of the Company, and any other person with a lawful entitlement to access the information.
5. By using our websites and portals, you consent to the receipt of direct marketing material. We will only use your personal information for this purpose if we have collected such information direct from you, and if it is material of a type which you would reasonably expect to receive from us. We do not use sensitive personal information in direct marketing activity. Our direct marketing material will include a simple means by which you can request not to receive further communications of this nature.

6. Access and correction

Australian Privacy Principle 12 permits you to obtain access by request to the personal information we hold about you in certain circumstances, and Australian Privacy Principle 13 allows you to correct inaccurate personal information subject to certain exceptions.
Our websites and portals that you have login credentials for will also enable you to add your own personal information. If you would like to change, modify, or delete information held by the Company, you must contact the Company by emailing brisbane@alchemyrc.com.au.

7. Complaint procedure

If you have a complaint concerning the manner in which we maintain the privacy of your personal information, please contact us as set out below. All complaints will be considered by the Directors, and we may seek further information from you to clarify your concerns. If we agree that your complaint is well founded, we will, in consultation with you, take appropriate steps to rectify the problem. If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner.

8. Overseas transfer

The Company does not intend to share your personal information with third parties operating outside of Australia. However, the Company does utilise online platforms, portals and websites owned and operated by third party organisations. Alchemy Recruitment Consulting does not operate said third party organisations who may occasionally engage international organisations or groups to service or maintain their online portals, websites, and platforms, or provide any other type of service that requires access to any set of data held by the third-party organisation.
As such, your personal information may be transferred overseas or stored overseas for a variety of reasons. It is not possible to identify each and every situation or country to which your personal information may be sent. If your personal information is sent to a recipient in a country with data protection laws which are at least substantially similar to the Australian Privacy Principles, and where there are mechanisms available to you to enforce protection of your personal information under that overseas law, we will not be liable for a breach of the Australian Privacy Principles if your personal information is mishandled in that jurisdiction.
If your personal information is transferred to a jurisdiction which does not have data protection laws as comprehensive as Australia’s, we will take reasonable steps to secure a contractual commitment from the recipient to handle your information in accordance with the Australian Privacy Principles.
